TERM OF SERVICE
1. Account
You may use your account only for your personal, non-commercial purposes. You shall not share the Account or the Login Information (such as Google Play account or Apple ID), neither should you let anyone else access your Account or do anything else that might threaten the security of your Account. You are solely responsible for keeping your Login Information confident, and you will be solely responsible for all uses of your Login Information, including any purchases or other changes to your Account and/or Account status, whether or not authorized by you. You are responsible for anything that happens through your Account. We will not be responsible for anything that happens through or to your Account and/or Account status as a result of you allowing any third party to access your Login Information and/or Account. In the event you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of the Login Information, you must immediately notify us and modify your Login Information. In the absence of such prompt notification we cannot guarantee the safety of your Service progress.
2. Ownership & License
We own & reserve all rights, title and interest in and to the Service, and all data and content included therein, without limitation any games, titles, including any game content such as computer code, objects, characters, dialogues, concepts, artwork, animations, catch phrases, sounds, musical compositions, audio-visual effects, methods of operation, documentation, in-game chat transcripts, character information, recordings of games played using our game client and server software.
We own and have rights to use any content that appears in the Services. You agree that you have no ownership, right or title in or to any content that appears in the Service, including without limitation (a) “Virtual Goods” or (b) “Virtual Currency” appearing or originating in any our Games Services, whether earned in a Service or purchased from us, or any other attributes associated with an Account or stored on the Service. You agree & acknowledge that you have no ownership or other property interest in the Account, and you further agree and acknowledge that all rights to the account are and shall forever be owned by us.
3. Security
We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
4. User Content
“User Content” means any communications, images, sounds, and all the material, data and information that users transmit through the Services. By transmitting or submitting any User Content while using the Services, you affirm, represent and warrant that such transmission or submission is:
(a) accurate and not confidential;
(b) not in violation of any laws, contractual restrictions or third-party rights, and that you have permission from any third party whose Personal Information or intellectual property is comprised in the User Content; and
(c) free of viruses, adware, spyware, worms or other malicious code.
We may, at any time, at its sole discretion and without prior notice, review, analyze, edit, delete, disable access to or otherwise make unavailable any User Content, regardless of its reasons in doing so.
We will not be held responsible for any submissions of User Content and assumes no responsibility for monitoring the Services in search of inappropriate content or material. We are not able and do not possess the resources necessary to analyze all User Content. Thus, We do not pre-screen or monitor all such content. By using the Services, you may be exposed to User Content that is offensive, indecent or otherwise not in line with your expectations. You bear all risks associated with your use of the Services and your access to any User Content available in connection with them.
At our discretion and only in terms according to the legislation we follow and respecting the rights established in our Policies, our representatives or technology may monitor and/or record your interaction with the Services or communications (including but not limited to chat text) when you are using the Services.
By entering into these Terms of Service, you hereby provide your irrevocable consent to such monitoring and recording, except for a COPPA purposes and regarding Children, where the parental consent will be obligatorily verified.
5. Display of Information Through the Services
a. User Ideas
We do not accept or take into account any unsolicited ideas displayed by Users, including ideas for new promotions, products, games, applications, technologies, processes or other ideas (collectively, "User Ideas"). You must not transmit to or through the Services or Third-Party Platforms any User Ideas that you consider to be confidential or proprietary. You agree that We shall not be required to treat any User Ideas as being confidential or proprietary. You are responsible and liable for any User Ideas you submit.
You agree that, by submitting User Ideas to us, including any concepts, know-how or technologies, you hereby grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicense able and transferable license to use, reproduce, distribute, sell, exploit, prepare derivative works of and display the User Ideas in connection with the Services, and with us (and its successor’s) business, including but not limited to promoting and redistributing part or all of the User Ideas (and derivative works thereof) in any media formats and through any media channels, whether now known or hereafter developed, without payment or accounting to you or others. We are under no obligation to evaluate, review, use or remunerate any User Idea.
b. Responsibility for Your Own Content
You are solely responsible for the information that you, by any means, share through our Services or in connection with the Services, and as well as for the information you provide to third parties. We reserve the right to reject, refuse to post or delete, at its sole discretion, for any or no reason, any User Content made available through the Services.
6. Services Updates
You understand that the Services are subject to further developments, adjustments and updates. you may be required to accept updates to the Services you have installed in your device in order to continue using them. You acknowledge and agree that we may, at its sole discretion, unilaterally update the Services, with or without notifying you. Additionally, you may also need to update third-party software from time to time in order to keep accessing and using the Services.
7. Playing our Games with other users
7.1. Some of our Games allow you to play against an opponent or to play socially with other users. You may be able to:
- Choose to play against another user or to play socially with another user whom RareSloth selects for you, or
- Play against, or play socially with, one of your contacts on a platform or social network which you have allowed our Games to interact with. Some of our Games may also allow you to search for your friends (for example, by email address) in order to find them to play against or play socially with. We may also display the display names of your past opponents so that you can easily find them to play again.
7.2. Where we select another user for you, we may either select at random or use such criteria as we see fit to select your opponent (for example, your past scores, your country, or the level you have reached in the Game or your other gameplay activity).
7.3. By accessing and/or playing our Games you agree that your display name, scores, avatar, country location, online/offline status and other related details may be displayed in any and all media (whether it exists now or in the future), for any purpose, in perpetuity, without any payment to you, including (without limitation) to other users in our games or within our marketing. You also understand and agree that other users may find you by searching for you with your email address. Please note that we will only show your display name publicly, and not your email address; another user must already know your email address themselves in order to search for you.
8. Your breach of these terms
Without limiting any other remedies or any other paragraph of these terms, if we reasonably believe that you are in material breach of these terms (including by repeated minor breaches), we reserve the right to take any of the following actions, whether individually or in combination, and either with or without notice to you:
- Delete, suspend and/or modify your account or parts of your account;
otherwise suspend and/or terminate your access to our Services;
- Modify and/or remove any Virtual Money or Virtual Goods that may be associated with your account;
- Reset and/or modify any game progression or benefits and privileges associated with your account, such as any level or score you have reached in our Games.
